Governing Documents. The governing documents of Mountain Park Condominiums Owners Association is subject to the Idaho State Statutes. In cases where differences may arise, it is usual that Statutes predominates. There is some flexibility in this. If a case is heard in a court of law then differences or interpretations can be adjudicated. Association documents can prevail.
Declaration. The full governing document is known as the Declaration. The developer of the property in the 1980’s is referred to in the Declaration as the Declarant. When the unit were sold by the developer, then an Association of Unit Owner was formed. Reference to the Declarant in the Declaration are now moot. The three most important parts of the Declaration with which unit owner need to be familiar are the CC&Rs, the Bylaws and a 1999 Amendment that restricted rental of any unit with certain exceptions. The CC&Rs are for operation of the Association. The Bylaws give rules for the Board to follow and for the Association regarding meetings. Separate sections pertain to the Membership and the Directors.
Rules & Regulations. The Board may provide additional documents to unit owners for use of the common areas and facilities.
Notices. For certain events the governing documents require Notice to be given as stated in the Bylaws and the CC&Rs.
Other Documents. Various other documents are posted to inform the Membership and to provide useful information.
- Fire Alarms 1415 1419 1420 – The documents provided show 2026 Monitoring for the Fire Alarms in all three building. This information is of value to reduce the cost of your Condo Insurance Policy. Most companies will consider a monitored system with dispatch to the fire department to reduce the policy’s cost to you.
- PMI Treasure Valley – Paul Justice is the local franchise owner of this management company. The services Paul provides are of great value to us at a very reasonable cost. In part, this is because all of our vendors are hired and their work is supervised here, without an intermediary mark-up as happens when vendors are hired by a management company.
- Emergencies – Various type of emergencies may happen from time to time. How these should be handled is given.
- Newsletters – On a periodic basis, additional information can be provided as a Newsletters, now a work in progress.
